Taction hopes the court will award additional damages for iPhone and Apple Watch sales made in 2026 plus hundreds of millions in prejudicial interest.
Even though Apple disputes a jury’s $5.7 billion verdict in the Taction patent case, the company hopes to get more. A jury found that Apple infringed two patents, albeit unintentionally, and Apple denied any wrongdoing.
According to a report by ReutersTaction has asked a federal judge for hundreds of millions more in payments from Apple. It claims that the damages only cover the period from 2021 to March 2026 and should also cover the previous six months.
Taction also sought prejudicial interest at California’s statutory rate of 7%. Interest on $5.7 billion would be an incredible amount on top of the already large sum.
The argument is simple. Taction states that “the size of the jury award is not a reason to withhold interest.”
Apple obviously intends to appeal and has already contested the jury’s verdict. It was supposedly made without material to accurately determine the payment of damages.
Furthermore, the logic of the case and the alleged violation are contradictory. Apple hopes to dismiss the case with summary judgment, but no verdict has yet been reached.
